                                                   SUMMONS
1. YOU ARE BEING SUED.  The Plaintiffs have started a lawsuit against you.  The Plaintiffs’ Complaint against you is on file in the office of the Court Administrator of the above-named Court. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this Summons.
 
2.   YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS.  You must give or mail to the person who signed this summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this Summons located at:

3.   YOU MUST RESPOND TO EACH CLAIM.  The Answer is your written response to the Plaintiffs’ Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiffs should not be given everything asked for in the Complaint, you must say so in your Answer.
 
4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS.  If you do not answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiffs everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond.  A default judgment can then be entered against you for the relief requested in the Complaint.
 
5. LEGAL ASSISTANCE.  You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case.
 
6.   ALTERNATIVE DISPUTE RESOLUTION.  The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.

THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS:
 
You are hereby summoned and required to serve upon Plaintiff’s attorney an Answer to the Complaint which is on file in the office of the Court Administrator of the above-named Court, within twenty (20) days after service of this Summons upon you, exclusive of the day of service.  If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.  
THIS ACTION involves, affects or brings into question real property situated in the County of Otter Tail, State of Minnesota described as follows:
All that part of Government Lot 1, Section 28, Township 131, Range 42, Otter Tail County, Minnesota, described as follows:
 
Commencing at northeast corner of said Section 28; thence South 89 degrees 56 minutes 06 seconds West (bearing based on Otter Tail County coordinates, 2011 adjustment) along the north line of said Section 28, a distance of 1565.48 feet; thence South 00 degrees 02 minutes 31 seconds East a distance of 219.00 feet to the point of beginning of the land to be described; thence continuing South 00 degrees 02 minutes 31 seconds East a distance of 62.40 feet; thence South 06 degrees 05 minutes 15 seconds East a distance of 37.99 feet; thence South 89 degrees 54 minutes 47 seconds West a distance of 268 feet more or less to the shoreline of  Ten Mile Lake; thence northerly along said shoreline to the intersection with a line which bears South 89 degrees 51 minutes 31 seconds West from the point of beginning; thence North 89 degrees 51 minutes 31 seconds East a distance of 227 feet more or less to the point of beginning. The sidelines of said easement shall terminate on the southerly right-of-way line of said County State Aid Highway No. 35. 
 
Subject to a mortgage in favor of Tradition Mortgage with MERS as nominee dated September 1, 2005, recorded in the office of the Otter Tail County Recorder as document number 983306.
 
YOU ARE FURTHER NOTIFIED that the object of this action is to obtain a judgment that Plaintiffs Jon B. Gunderson and Teresa J. Shannon are the owners in fee simple of the above-described real property subject to the mortgage of Plaintiff Tradition Mortgage; and that the Defendants, and each of them, be declared to have no right, title, estate, right to possession, lien or interest in the real estate described above.  
The Defendants will take notice that no personal claim is made by the Plaintiff against any of the defendants.
