It is Ordered and Notice is given that on January 3rd, 2016, at 1:30 p.m., a hearing will be held in this Court at 121 West Junius Avenue, Fergus Falls, Minnesota, for the adjudication of intestacy and determination of heirship of the Decedent, and for the appointment of Amy J. Anderson, whose address is 636 West Linden, Fergus Falls, MN 56537 as Personal Representative of the Estate of the Decedent in a SUPERVISED administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate, including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property and to do all necessary acts for the Estate.
 
Notice is also given that (subject to Minnesota Statutes section 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

Any objections to the petition must be raised at the hearing or filed with the Court prior to the hearing. If the petition is proper and no objections are filed or raised, the personal representatives will be appointed with the full power to administer the decedent’s estate, including the power to collect all assets; pay all legal debts, claims, taxes and expenses; to sell real and personal property and do all necessary acts for the decedent’s estate.

3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiffs’ Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiffs should not be given everything asked for in the Complaint, you must say so in your Answer.
 
4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS.  If you do not answer within 20 days, you will lose this case. Notice is given that an application for informal probate of the Decedent’s Will, dated December 6, 2007, (“Will”), has been filed with the Registrar. The application has been granted.
 
Notice is also given that the Registrar has informally appointed Robin Messer-Olson whose address is 621 W. Beech, Fergus Falls, MN 56537, as Personal Representative of the Estate of the Decedent. Any Heir, devisee or other interested person may be entitled to appointment as personal representative or may object to the appointment of the personal representative. Unless objections are filed with the Court (pursuant to Minn. Stat. 524.3-607) and the Court otherwise orders, the personal representative has full power to administer the Estate including, after 30 days from the date of issuance of letters, the power to sell, encumber, lease or distribute real estate.
 
Any objections to the probate of the will or appointment of the personal representative must be filed with this court and will be heard by the Court after the filing of an appropriate petition and proper notice of hearing.
 
Notice is also given that (subject to Minn. Stat. 524.3-801) ALL CREDITORS having claims against estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or said claims will be forever barred.
