Weber in Relation to Real Property registered in Certificate of Title No. 2793 for an Order Withdrawing Land from Registration, AND In the Matter of Plaintiffs and Petitioners, Darren A. Weber and Eileen R. Weber, as and for their Petition and Complaint to vacate a portion of abandoned road and quiet title, Plaintiffs, v. Otter Tail County, Leaf Lake Township, First National Bank of Henning, Anton Thompson, R. Vinje Thompson, Mary L. Seymour, Karri Kuester, Lori Schultz, Marcy Maskrey, Stacey Schultz-Steinger, Teresa D Theisen, Jeffrey L. Perala, Joel S. Perala, Tawnia B. Hoehne, Jason M. Perala, Jared R. Perala, Tara M. Baune, Norman W. Umland as Trustee of the Umland Trust, Judith A. Umland as Trustee of the Umland Trust, Donn L. Hoffman and Pam A. Hoffman, Timothy Fiskum, Wayne and Shirley Springer, Nancy J. Stramer, and the unknown heirs of the above-named persons now deceased and any and all other persons unknown claiming any right, title, or interest in the premises described herein. Defendants. _________________________________________________________ THIS SUMMONS IS DIRECTED TO THE ABOVE-NAMED DEFENDANTS, and the unknown heirs of any of the above-named persons now deceased, also all other persons unknown claiming any right, title, estate, interest or lien in the real estate described in the Complaint herein. 1. YOU ARE BEING SUED: The Plaintiffs/Petitioners (hereinafter collectively “Plaintiffs”) have started a lawsuit against you. The Plaintiffs’ Complaint against you is attached to this Summons and is on file in the office of the Court Administrator of the above-named Court. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this Summons. 2. YOU MUST REPLY WITHIN 21 DAYS TO PROTECT YOUR RIGHTS. YOU MUST REPLY WITHIN 60 DAYS IF YOU ARE THE UNITED STATES OF AMERICA. You must give or mail to the person who signed this summons a written response called an Answer within TWENTY-ONE (21) days, or SIXTY (60) days if you are the United States or a United States Agency, or an Officer or Employee of the United States described in Fed. R. Civ. P. 12 (a)(2) or (3), of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this Summons located at: Paul S. The Answer is your written response to the Plaintiffs’ Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiffs should not be given everything asked for in the Complaint, you must say so in your Answer. 4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not answer within 21 days, you will lose your case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiffs everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond. A default judgment can then be entered against you for the relief requested in the Complaint. 5. LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case. 6. ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute. 7. THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY located in Otter Tail County, State of Minnesota, legally described as follows: Lots Two (2) and Three (3) of Block Three (3), except the North 1.00 foot of the East 44.76 feet of Lot 3, Block 3, LEAF LAKE PLEASURE GROUNDS, according to the plat thereof, Otter Tail County, Minnesota, said distances are measured at right angles to the North and East lines of said Lot 3. AND The South 2.00 feet of Lot 4, Block 3, LEAF LAKE PLEASURE GROUNDS, according to the recorded plat thereof, Otter Tail County, Minnesota, lying West of the East 44.76 feet of said Lot 4, said distance of 2.00 feet and 44.76 feet are measured at right angles to the South and East lines of said Lot 4. AND Lot Nine (9) and Eight (8) of Block Two (2) in LEAF LAKE PLEASURE GROUNDS, according to the certified and recorded plat thereof. AND PARCEL A All that part of Government Lot 5, Section 22, Township 134, Range 38, Otter Tail County, Minnesota, described as follows: Beginning at the southeast corner of Lot 8, Block 2, LEAF LAKE PLEASURE GROUNDS, according to the recorded plat thereof; thence North 06 degrees 52 minutes 47 seconds West on an assumed bearing along the easterly line of said Lot 8, a distance of 16.90 feet to an angle point on said easterly line; thence North 11 degrees 21 minutes 51 seconds East along said easterly line of Lot 8 and along the easterly line of Lot 9, said Block 2, a distance of 66.69 feet to the northeast corner of said Lot 9; thence North 89 degrees 05 minutes 00 seconds East a distance of 7.55 feet; thence southerly on a non-tangential curve, concave to the east, having a radius of 727.50 feet, a delta angle of 6 degrees 29 minutes 20 seconds and a chord bearing South 02 degrees 35 minutes 44 seconds West, for an arc distance of 82.39 feet; thence South 89 degrees 56 minutes 12 seconds West a distance of 14.93 feet to the point of beginning. Containing 1,036 square feet more or less. AND PARCEL B All that part of Government Lot 5, Section 22, Township 134, Range 38, Otter Tail County, Minnesota, described as follows: Beginning at the southwest corner of Lot 2, Block 3, LEAF LAKE PLEASURE GROUNDS, according to the recorded plat thereof; thence North 06 degrees 52 minutes 47 seconds West on an assumed bearing along the westerly line of said Lot 2, a distance of 13.00 feet to an angle point on said westerly line; thence North 11 degrees 21 minutes 51 seconds East along said westerly line of Lot 2 and along the westerly line of Lots 3 and 4, said Block 3, a distance of 72.66 feet; thence South 88 degrees 56 minutes 26 seconds West a distance of 26.96 feet; thence southerly on a non-tangential curve, concave to the east, having a radius of 694.50 feet, a delta angle of 6 degrees 55 minutes 29 seconds and a chord bearing South 02 degrees 52 minutes 24 seconds West, for an arc distance of 83.94 feet; thence North 89 degrees 33 minutes 27 seconds East a distance of 18.40 feet to the point of beginning. Containing 1,825 square feet more or less. The object of this action is to determine the title and adverse claims to the real property described above and to have Plaintiffs adjudged the owners thereof in fee simple.
