STATE OF MINNESOTA IN DISTRICT COURT COUNTY OF OTTER TAIL SEVENTH JUDICIAL DISTRICT Court File No. 56-CV-24-934 Quiet Title Susan D. Misterek, Trustee of the Susan D. Misterek Living Trust dated February 6, 2018, Plaintiffs, vs. Northeast Bank, a Minnesota corporation, Jon B. Swarts, Donald C. Meyer, Sally A. Meyer, Brandon Meyer; also the unknown heirs, successors or assigns of any of the above defendants, and all other persons unknown claiming any right, title, estate, interest or lien in the real estate described in the complaint herein. Defendants. SUMMONS THIS SUMMONS IS DIRECTED TO: Defendant Northeast Bank, 77 Broadway Street Northeast, Minneapolis, MN 55413; Defendant Jon B. Swarts, 35261 Turner Dr., Battle Lake, MN 56515-9195; Defendant Donald C. Meyer, 27182 County Hwy 83, Battle Lake, MN 56515; Defendant Sally A. Meyer, 27182 County Hwy 83, Battle Lake, MN 56515; Defendant Brandon Meyer, 27182 County Hwy 83, Battle Lake, MN 56515. 1. YOU ARE BEING SUED. The Plaintiffs started a lawsuit against you. The Plaintiffs’ Complaint against you is attached to this Summons. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this Summons. 2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this Summons located at: 220 West Washington Ave., Suite 105 Fergus Falls, MN 56537 3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiffs’ Complaint. In your Answer, you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiffs should not be given everything asked for in the Complaint, you must say so in your Answer. Court File No. 56-CV-24-934 4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiffs everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond. A default judgment can then be entered against you for the relief requested in the Complaint. 5. LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case. 6. ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute. 7. THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY located in Otter Tail County, State of Minnesota, legally described as follows: Lot 5, MAPLE BEACH ON DEER LAKE, according to the recorded plot thereof, Otter Tail County, Minnesota and that part of the Government Lot 5, Section 5, Township 133, Range 40, described as follows: Commencing at the most northerly corner of Lot 5; thence North 33 degrees 53 minutes 10 seconds West, bearing based on said plat of MAPLE BEACH ON DEER LAKE, along the northeasterly line of Lot 6, said plat of MAPLE BEACH ON DEER LAKE. a distance of 85.97 feet to the most northerly corner of said lot 6; thence North 48 degrees 47 minutes 20 seconds East along the southerly line of a tract of land described in a Judgment filed as Document No. 899287 in the office of the Otter Tail County Recorder a distance of 58.00 feet; thence North 89 degrees 58 minutes 26 seconds East along said southerly line of a tract of land described in Document No. 899287, a distance of 226.35 feet to the westerly line of a tract of land described in a Judgment filed as Document No. 844865, in the office of the Otter Tail County Recorder; thence South 0 degrees 31 minutes 28 seconds East along said westerly line of a tract of land described in Document No. 844865, a distance of 27.51 feet to the point of beginning of the land to be described; thence South 69 degrees 42 minutes 50 seconds West a distance of 237.01 feet to said most northerly corner of Lot 5; thence South 33 degrees 50 minutes 54 seconds East along the northeasterly line of said Lot 5, a distance of 90.77 feet to the most easterly corner of said Lot 5; thence North 58 degrees 00 minutes 35 seconds East a distance of 203.04 feet to said westerly line of a tract of land described in Document No. 844865; thence North 0 degrees 31 minutes 28 seconds West said westerly line of a tract of land described in Document No. 844865, a distance of 50.00 feet to the point of beginning.
