THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS:

You are hereby summoned and required to serve upon Plaintiffs’ attorney an Answer to the Amended Complaint which is on file in the office of the Court Administrator of the above-named Court, within twenty (20) days after service of this Amended
Summons upon you, exclusive of the day of service. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Amended Complaint.
THIS ACTION involves, affects or brings into question real property situated in the County of Otter Tail, State of Minnesota described as follows:

Government Lot 1, Section 4, Township 133, Range 40, Otter Tail County, Minnesota, except the following described real property:

All that part of Government Lots 1 and 2, Section 4, Township 133, Range 40, Otter Tail County, Minnesota, described as follows:

Commencing at the southwest corner of said Government Lot 1; thence North 00 degrees 38 minutes 41 seconds West (bearing is based on Otter Tail County Coordinates – 2011 Adjustment) along the west line of said Government Lot 1, a distance of 1252.00 feet; thence North 78 degrees 41 minutes 18 seconds East a distance of 27.21 feet to the point of beginning of the land to be described; thence continuing North 78 degrees 41 minutes 18 seconds East a distance of 43.00 feet; thence North 07 degrees 49 minutes 38 seconds West a distance of 37.85 feet; thence North 71 degrees 35 minutes 21 seconds East a distance of 194.73 feet; thence North 76 degrees 59 minutes 38 seconds East a distance of 65.72 feet; thence North 06 degrees 14 minutes 09 seconds West a distance of 230 feet more or less to the shoreline of Otter Tail Lake; thence southwesterly along said shoreline to the intersection with a line which bears North 08 degrees 22 minutes 07 seconds West from the point of beginning; thence South 08 degrees 22 minutes 07 seconds East a distance of 209 feet more or less to the point of beginning.

AND EXCEPT

The Plat of Matthews Beach, dated November 2nd, 1973 and recorded in the office of the Otter Tail County Recorder on July 19th, 1976.

AND EXCEPT

That part of Government Lot 1, Section 4, Township 133, Range 40, Otter Tail County, Minnesota, described as follows:

Beginning at the Southwest corner of Lot 9 of the Subdivision Plat of Matthews Beach as of public record in the office of the County Recorder in and for said Otter Tail County thence on an assumed bearing of South 07 degrees 19 minutes 31 seconds East on a prolongation of the westerly line of said Lot 9 for a distance of 136.79 feet; thence South 69 degrees 44 minutes 19 seconds West 170.75 feet; thence North 10 degrees 07 minutes 07 seconds West 453 feet, more or less, to the shoreline of Otter Tail Lake, thence easterly on said shoreline to the westerly line of said Lot 9; thence South 07 degrees 19 minutes 31 seconds East on the westerly line of said Lot 9 for a distance of 305 feet, more or less, to the point of beginning.

YOU ARE FURTHER NOTIFIED that the object of this action is to obtain a judgment that Plaintiffs and Defendants Roland R. Mann and Lori M. Mann are the owners in fee simple of the above-described real property as allocated in the Amended Complaint; and that other than described and allocated in the complaint the Plaintiffs and Defendants, and each of them, be declared to have no right, title, estate, right to possession, lien or interest in the real estate described above.
The Defendants will take notice that no personal claim is made by the Plaintiffs against any of the Defendants.
