Olson; Eagle Bank; United Wholesale Mortgage, LLC; West Central Bank; Bell State Bank & Trust; State of Minnesota; Otter Tail County; Elizabeth Township; and also the unknown heirs of the defendants herein and all other persons unknown claiming any right, title, estate, interest, or lien in the real estate described herein, Defendants. _________________________________________________________ AMENDED SUMMONS THIS SUMMONS IS DIRECTED TO THE DEFENDANTS ABOVE NAMED: 1. YOU ARE BEING SUED. The Plaintiffs have started a lawsuit against you. The Plaintiffs’ Complaint against you is on file in the office of the Court Administrator of the above-named court. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this Summons. 2. YOU MUST REPLY WITHIN 21 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this Summons a written response called an Answer within 21 days of the date on which you received this Summons, except that the United States and its officers and agencies shall file a motion or answer to the Complaint within 60 days of the date on which this Summons is received. You must send a copy of your Answer to the person who signed this Summons located at: Robert L. Russell, Attorney at Law 220 W. Washington Ave., Suite 103 Fergus Falls, MN 56537 3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiffs’ Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiffs should not be given everything asked for in the Complaint, you must say so in your Answer. 4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not Answer within 21 days (or 60 days in the case of the United States and its officers and agencies), you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiffs everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond. A default judgment can then be entered against you for the relief requested in the Complaint. 5. LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case. 6. ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute. 7. AND YOU ARE HEREBY NOTIFIED that the object of this action is to determine the title and adverse claims to the lands hereinafter described, and that THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY located in the County of Otter Tail and State of Minnesota, legally described as follows: That part of Government Lot 3, Section 24, Township 134, Range 43, described as follows: Commencing at the center of said Section 24; thence on an assumed bearing of South 88 degrees 17 minutes 37 seconds East along the east-west quarter line of said Section 24, a distance of 147.17 feet; thence South 45 degrees 33 minutes 23 seconds West a distance of 217.82 feet; thence South 45 degrees 43 minutes 19 seconds West a distance of 141.14 feet; thence South 47 degrees 10 minutes 18 seconds West a distance of 208.89 feet to the point of beginning of the land to be described; thence continuing South 47 degrees 10 minutes 18 seconds West a distance of 65.97 feet; thence North 42 degrees 08 minutes 03 seconds West a distance of 137 feet more or less to the shoreline of Jewett Lake; thence northeasterly along said shoreline to the intersection with a line which bears North 42 degrees 02 minutes 13 seconds West from the point of beginning; thence South 42 degrees 02 minutes 13 seconds East a distance of 133 feet more or less to the point of beginning, containing 8,991 square feet more or less; AND That part of Government Lot 3, Section 24, Township 134, Range 43, described as follows: Commencing at the center of said Section 24; thence on an assumed bearing of South 88 degrees 17 minutes 37 seconds East along the east-west quarter line of said Section 24, a distance of 147.17 feet; thence South 45 degrees 33 minutes 23 seconds West a distance of 217.82 feet; thence South 45 degrees 43 minutes 19 seconds West a distance of 141.14 feet; thence South 47 degrees 10 minutes 18 seconds West a distance of 140.93 feet to the point of beginning of the land to be described; thence continuing South 47 degrees 10 minutes 18 seconds West a distance of 67.96 feet; thence North 42 degrees 02 minutes 13 seconds West a distance of 133 feet more or less to the shoreline of Jewett Lake; thence northeasterly along said shoreline to the intersection with a line which bears North 41 degrees 56 minutes 10 seconds West from the point of beginning; thence South 41 degrees 56 minutes 10 seconds East a distance of 134 feet more or less to the point of beginning, containing 9,108 square feet more or less. TOGETHER WITH AND SUBJECT TO AN EASEMENT FOR ROADWAY PURPOSES, over and across that part of Government Lot 3, Section 24, Township 134, Range 43, being a strip of land of varying width, approximately 33 to 35 feet wide, bounded and contained within the five following described lines: Line One: Commencing at the center of said Section 24; thence on an assumed bearing of South 88 degrees 17 minutes 37 seconds East along the east-west quarter line of said Section 24, a distance of 147.17 feet; thence South 45 degrees 33 minutes 23 seconds West a distance of 217.82 feet; thence South 45 degrees 43 minutes 19 seconds West a distance of 141.14 feet; thence South 47 degrees 10 minutes 18 seconds West a distance of 74.96 feet to the point of beginning of Line One; thence continuing South 47 degrees 10 minutes 18 seconds West a distance of 199.90 feet; thence South 42 degrees 57 minutes 06 seconds West a distance of 138.96 feet to the point of termination of said Line One. Line Two: Commencing at the aforementioned point of termination of said Line One; thence South 57 degrees 07 minutes 00 seconds West a distance of 41.10 feet to the most easterly corner of Lot 1, Sunset Beach, according to the recorded plat thereof; thence South 32 degrees 53 minutes 00 seconds East along the northeasterly line of said Sunset Beach, a distance of 33.00 feet to the most northerly corner of Lot 1, Block 1, Chet’s Addition to Sunset Beach, according to the recorded plat thereof; thence North 57 degrees 07 minutes 00 seconds East a distance of 45.20 feet to the point of beginning of Line Two; thence North 42 degrees 49 minutes 00 seconds East a distance of 62.20 feet to a point hereinafter referred to as Point A and the point of termination of said Line Two. Line Three: Commencing at the center of said Section 24; thence on an assumed bearing of South along the east line of said Government Lot 3, a distance of 194.90 feet; thence South 45 degrees 33 minutes 00 seconds West a distance of 196.60 feet; thence South 47 degrees 51 minutes 00 seconds West a distance of 0.47 feet to the point of beginning of Line Three; thence continuing South 47 degrees 51 minutes 00 seconds West a distance of 197.53 feet; thence South 43 degrees 14 minutes 44 seconds West a distance of 80.17 feet to the aforementioned Point A and the point of termination of said Line Three. Line Four: A straight line connecting the point of termination of said Line One with the point of beginning of said Line Two. Line Five: A straight line connecting the point of beginning of said Line One with the point of beginning of said Line Three. And together with that part of the Access Road Easement, as shown on Chet’s Addition to Sunset Beach, according to the recorded plat thereof, that lies southeasterly of the following described line: Commencing at the most easterly corner of Lot 1, Sunset Beach, according to the recorded plat thereof; thence on an assumed bearing of South 32 degrees 53 minutes 00 seconds East along the northeasterly line of said Sunset Beach, a distance of 33.00 feet to the most northerly corner of Lot 1, Block 1, said Chet’s Addition to Sunset Beach, the point of beginning of the line to be described; thence North 57 degrees 07 minutes 00 seconds East a distance of 45.20 feet; thence North 42 degrees 49 minutes 00 seconds East a distance of 21.47 feet to the northeasterly line of the Access Road Easement as shown on said Chet’s Addition to Sunset Beach and there terminating; Dated: January 10, 2025 ROBERT L.
