Defendants. _________________________________________________________ TO THE ABOVED-NAMED DEFENDANT: THIS SUMMONS IS AN OFFICIAL DOCUMENT THAT AFFECTS YOUR RIGHTS. A copy of the paperwork regarding the lawsuit is served on you with this summons. Read this summons and attachments carefully. If you do not understand it, contact an attorney for legal advice. 1. YOU ARE BEING SUED. The Plaintiff has started a lawsuit against you. The Plaintiff’s Complaint against you is attached to this Summons. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this Summons. 2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this Summons a written response called an Answer within 20 days of the date on which you received this Summons. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiff’s Complaint. In your Answer, you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiff should not be given everything asked for in the Complaint, you must say so in your Answer. 4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiff everything asked for in the Complaint. This action involves, affects, or brings into question real estates situated in the County of Otter Tail, State of Minnesota, legally described as follows: Government Lots 7 and 8, and the S 1⁄2 of the SE, except lands North and East of Highway #94, and the NE 4 of the SE 4 South and West of Highway #94, all in Section 26, Township 131, Range 42, Otter Tail County, Minnesota, Except the following 2 parcels: Exception 1: That part of Southeast Quarter in Section 26, Township 131 North, Range 42 West of the 5th Principal Meridian, Otter Tail County, Minnesota, described as follows: Commencing at the southeast comer of said Section 26: thence on an assumed bearing of North 0 degrees 31 minutes 31 seconds East on the easterly line thereof for a distance of 545.82 feet; thence North 89 degrees 19 minutes 22 seconds West 667.17 feet; thence South 88 degrees 29 minutes 20 seconds West 206.65 feet; thence South 17 degrees 38 minutes 15 seconds East a distance of 575.27 feet to the South line of said Southeast; thence on a bearing of East along said South line a distance of 694.39 feet to the point of beginning. AND The SW 4 of the SW 4 south and west of Highway #94, in Section 26; Township 131, Range 42, AND The NW 1/4 of the NW 4, except land north and east of Highway #94, in Section 36, Township 131, Range 42. The object of this action is to determine title and adverse claims to the above described land, and to determine that Defendants have no right, title, estate, lien or interest in the above described real estate.
