Defendants. ––––––––––––––––––––––––––––––––––––––––––––––––––––––––– SUMMONS ––––––––––––––––––––––––––––––––––––––––––––––––––––––––– THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFEDANTS: You are hereby summoned and required to serve upon Plaintiffs’ attorney an Answer to the Complaint which is on file in the office of the Court Administrator of the above-named Court, within twenty (20) days after service of this Summons upon you, exclusive of the day of service. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint. THIS ACTION involves, affects or brings into question real property situated in the County of Otter Tail, State of Minnesota described as follows: Lot C of INGLEWOOD OTTER TAIL CO. MINNESOTA, said plat is on file in the office of the Recorder of Otter Tail County, Minnesota and that part of Government Lot 5, Section 6, Township 133, Range 39, said County, all being described as follows: Commencing at the Center of said Section 6, as evidenced by an inplace certified cast iron monument; thence on an assumed bearing of North 89 degrees 41 minutes 47 seconds West along the east-west quarter line of said Section 6, a distance of 1294.54 feet to the northeast corner of said Government Lot 5; thence South 01 degree 02 minutes 53 seconds East along the east line of said Government Lot 5, a distance of 802.36 feet to the point of beginning of the land to be described; thence North 89 degrees 53 minutes 49 seconds West a distance of 634.29 feet; thence South 01 degree 06 minutes 16 seconds East a distance of 490.88 feet to the northerly line of an Alley, as dedicated in said INGLEWOOD OTTER TAIL CO. MINNESOTA; thence South 86 degrees 09 minutes 38 seconds East along said northerly line, a distance of 11.39 feet to the easterly line of said Alley; thence South 01 degree 09 minutes 38 seconds East along said easterly line, a distance of 20.08 feet to the northeasterly corner of said Lot C; thence North 86 degrees 09 minutes 38 seconds West along the northerly line of said Lot C, a distance of 83.00 feet to the northwesterly corner of said Lot C; thence South 01 degree 09 minutes 38 seconds East along the westerly line of said Lot C, a distance of 320 feet more or less, to the shoreline of Blanche Lake; thence easterly, along said shoreline to said east line of Government Lot 5; thence North 01 degree 02 minutes 53 seconds West along said east line, a distance of 811 feet more or less, to the point of beginning. Containing 12.47 acres more or less. Subject to the rights of the public in Blanche Creek Road across the northeasterly corner thereof. Together with an easement for ingress, egress and utility purposes, over, under and across that part of Government Lot 5, Section 6, Township 133, Range 39, Otter Tail County, Minnesota, being a strip of land lying 10.00 feet on each side of and adjoining the following described centerline: Commencing at the Center of said Section 6, as evidenced by an inplace certified cast iron monument; thence on an assumed bearing of North 89 degrees 41 minutes 47 seconds West along the east-west quarter line of said Section 6, a distance of 1294.54 feet to the northeast corner of said Government Lot 5; thence South 01 degree 02 minutes 53 seconds East along the east line of said Government Lot 5, a distance of 802.36 feet; thence North 89 degrees 53 minutes 49 seconds West a distance of 634.29 feet; thence South 01 degree 06 minutes 16 seconds East a distance of 156.68 feet to the point of beginning of the centerline to be described; thence northwesterly, on a non-tangential curve concave to the northeast, having a radius of 312.54 feet, a delta angle of 28 degrees 22 minutes 24 seconds and a chord bearing of North 58 degrees 38 minutes 39 seconds West, for an arc distance of 154.77 feet; thence North 44 degrees 27 minutes 27 seconds West a distance of 108.30 feet to the southerly right-of-way line of Blanche Creek Road and there terminating. The sidelines of said easement shall be prolonged or shortened to terminate on a line which bears North 01 degree 06 minutes 16 seconds West and South 01 degree 06 minutes 16 seconds East from the point of beginning of said centerline and shall be prolonged or shortened to terminate on said southerly right-of-way line of Blanche Creek Road. AND Subject to an Otter Tail Power Company easement found in the Office of the Otter Tail County Recorder as document number 1278381, recorded June 20, 2022. YOU ARE FURTHER NOTIFIED that the object of this action is to obtain a judgment that Plaintiff Robert & Phyllis Narveson LLC, a Minnesota Limited Liability Company is the owner in fee simple of the above-described real property; and that the Defendants, and each of them, be declared to have no right, title, estate, right to possession, lien or interest in the real estate described above. The Defendants will take notice that no personal claim is made by the Plaintiffs against any of the Defendants.
