Defendants. ———————————————————————————————– SUMMONS ———————————————————————————————– THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS: You are hereby summoned and required to serve upon Plaintiffs’ attorney an Answer to the Complaint which is on file in the office of the Court Administrator of the above-named Court, within twenty (20) days after service of this Summons upon you, exclusive of the day of service. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint. THIS ACTION involves, affects or brings into question real property situated in the County of Otter Tail, State of Minnesota described as follows: That part of the Northeast Quarter of the Southeast Quarter in Section 11, Township 131 North, Range 42 West of the Fifth Principal Meridian in Otter Tail County, Minnesota. Commencing at the east quarter corner of said Section 11; thence North 89 degrees 44 minutes 22 seconds West 949.23 feet on an assumed bearing along the east-west quarter line of said Section 11 to the southwesterly line of the former Burlington Northern Railroad, said point is the point of beginning; thence continuing North 89 degrees 44 minutes 22 seconds West 170.80 feet along said east-west quarter line to the intersection with the northerly extension of the easterly line of NEW HOME ADDITION TO DALTON, said plat is on file and of record in the office of the Recorder in said County; thence South 00 degrees 13 minutes 59 seconds East 170.02 feet along said extension and along said easterly line; thence North 86 degrees 39 minutes 23 seconds East 175.95 feet to the northwesterly corner of a tract of land described in Document No. 1139602, said document is on file and of record in the office of the Recorder in said County; thence North 88 degrees 09 minutes 58 seconds East 104.07 feet along the northerly line of said tract of land to the northeasterly corner of said tract of land and the southwesterly line of said Former Burlington Northern Railroad; thence North 35 degrees 08 minutes 35 seconds West 190.35 feet along said southwesterly line of the Former Burlington Northern Railroad to the point of beginning; The above described tract contains 36,788 sq. ft. SUBJECT TO the rights of the public for road purposes for West Main Street and Birch Avenue. FURHTER SUBJECT TO a 25.00 foot wide roadway easement over, under and across the easterly line of the above described tract, the westerly sideline of said 25.00 foot wide roadway easement is measured at a right angle to and is parallel with the easterly line of the above described tract. YOU ARE FURTHER NOTIFIED that the object of this action is to obtain a judgment that Plaintiffs are the owners in fee simple of the above-described real property; and that the Defendants, and each of them, be declared to have no right, title, estate, right to possession, lien or interest in the real estate described above. The Defendants will take notice that no personal claim is made by the Plaintiffs against any of the Defendants.
