Case Type: 10 STATE OF MINNESOTA DISTRICT COURT COUNTY OF OTTER TAIL SEVENTH JUDICIAL DISTRICT Court File # 56-CV-25-318 ———————————————————————————————– LAND TITLE SUMMONS IN PETITION FOR REGISTRATION OF BOUNDARIES In the Matter of the Petition of Karen Ruth Zell-Verhelst, Trustee, Under the Verhelst Family Revocable Living Trust Dated February16, 2021, in relation to land in Otter Tail County described as: All that part of Reserve Block F of Leaf Lake Pleasure Grounds and Government Lot 5, Section 22, Township 134, Range 38, lying east of new State Trunk Highway No. 108, described by metes and bounds as follows: Beginning at a point on the east line of said new Trunk Highway No. 108 319 feet southwesterly from the point where the north line of said Reserve Block F intersects the east line of said Trunk Highway, thence easterly to a point 35 feet due south from an elm tree with three stems on the west shore of East Leaf Lake, thence due east to the west shore of said East Leaf Lake, thence southerly and southeasterly along the west shore of said East Leaf Lake to the south line of said Government Lot 5, thence west on and along the south line of said Government Lot 5 to the east line of said new Trunk Highway No. 108, thence northeasterly along the east line of said Trunk Highway No. 108, to the point of beginning, except the following described tracts: That part of Reserve Block “F” Leaf Lake Pleasure Grounds described as follows: Commencing at a point on the easterly right-of-way line of State Trunk Highway No. 108 a distance of 319 feet southwesterly of the intersection of said easterly line and the northerly line of said Block “F”, said point being the northwesterly corner of tract owned by Gust and Else Jordan; thence on an assumed bearing of South 30 degrees 13 minutes West on said Easterly right-of-way line for a distance of 100 feet to point of beginning; thence North 30 degrees 13 minutes East 100 feet; thence North 85 degrees East 454 feet more or less to a point 35 feet South of a three stem Elm tree as referred to in Torrence Deed to Gust and Else Jordan; thence Southerly on the easterly line of said Reserve Block “F” to the intersection of a line projected at South 78 degrees east from point of beginning; thence North 78 degrees west to point of beginning. AND FURTHER EXCEPTING: That part of Reserve Block “F” of the Subdivision of LEAF LAKE PLEASURE GROUNDS as of public record in the office of the County Recorder in and for the County of Otter Tail and State of Minnesota, described as follows: Commencing at the most southerly corner of Lot 1, Block 1, of said LEAF LAKE PLEASURE GROUNDS, said point also being on the westerly line of Section 22, Township 134, Range 38; thence on an assumed bearing of south and on the westerly line of said Section 22 for a distance of 358.73 feet; thence North 69 degrees 02 minutes 20 seconds East 238.72 feet to point of beginning of tract to be described; said point being on the easterly right of way line of State Trunk Highway No. 108; and also on an arc of said right of way having a radius of 879.93 feet and whose radial point bears South 56 degrees 21 minutes 52 seconds East; thence northeasterly on said arc and right of way for a distance of 65.36 feet; thence continuing on said right of way and on a bearing of North 37 degrees 53 minutes 30 seconds East 284.47 feet; thence South 67 degrees 27 minutes East 90 feet; thence South 22 degrees 25 miutes 10 seconds West 338.15 feet; thence North 67 degrees 27 minutes West 180 feet to point of beginning. Together with an easement of 10 feet in width immediately adjacent to and northeast of the northeasterly line of the hereinbefore parcel and reserving unto grantors a 10 feet easement immediately adjacent to and southwest of said northeasterly line. Spencer, all whose true names are unknown, also all heirs and devisees of any of the above named persons who are deceased; and all other persons or parties unknown, claiming any right, title, estate, lien or interest in the real estate described in the application or amendments therein, Defendants. You are hereby summoned and required to answer the Petition of the Petitioner in the above-entitled proceeding and to file your answer to said Petition in the Office of the Court Administrator, Otter Tail County, within twenty-one (21) days after service of this Summons upon you exclusive of the date of service,and if you fail to answer the Petition within the time aforesaid, the Petitioner in this proceeding will apply to the Court for the relief demanded therein.
